Privacy Policy

1. GENERAL INFORMATION

This policy (“Privacy Policy”) explains what information Splickit, Inc. and its subsidiaries or service providers collect from, or about, users of the Splickit Platform, including any services that Splickit may provide through the ordering websites, mobile applications, and any other services that Splickit may provide through the Splickit Platform (collectively, the “Services”), and other interactions necessary to manage and fulfill services.

If you are outside the European Economic Area (EEA), by accessing and using the Splickit Platform and its Services, you have agreed to the use of your data as described in this Privacy Policy. If you are in the EEA, by accessing the Ordering Websites, you have agreed to the use of your data as described in this Privacy Policy. It also describes the choices regarding use, access and collection of personal information as well as your rights to your personal data that we process. If you do not agree with the terms, please do not access or use the Splickit Services.

2. SCOPE

This Privacy Policy applies to personal information and other information Splickit collects from or about the users in connection with the Splickit Platform and its mobile applications, as well as other interactions necessary to manage and fulfill orders. Unless otherwise specified below, this Privacy Policy does not apply to any other products or services or to information collected in any other way (whether online or offline) or for any other purpose.

3. INFORMATION WE COLLECT

3.1 Personal Information
For purposes of this Privacy Policy, “personal information” means information that can be used to personally identify you, such as your name, address, phone number, e-mail address, birthdate, passwords, device information, billing and transaction information, credit card or other financial information, contact preferences, and similar information.

Splickit may collect, store, or process personal information and other information from or about you when you:

Your decision to provide this personal information is voluntary. However, if you do not provide the personal information requested, you may not be able to proceed with the activity or receive the benefit for which the personal information is being requested.

3.2 Other Information
We may also collect information that is related to you, such as your computer’s operating system, browser, geolocation, and your use of and activities on the ordering websites, mobile applications, and other Services.

Information that we automatically collect when you use the services, such as (i) information about the device from which you access the Services, the operating system and version (for example iOS, Android or Windows); (ii) your IP addresses (which may consist of a static or dynamic IP address; (iii) browser type and language; (iv) referring and exit pages and URLs; (v) date and time; (vi) amount of time spent on particular pages; (vii) what features of the services you use or visit; (viii) what you order and from which restaurants; and (ix) similar information concerning your use of the services.

Information that we collect using cookie technology. Cookies are small packets of data that a website stores on your computer’s hard drive, so that your computer will remember information about your visit. We may use cookies to authenticate users and to personalize your experience when using the services. To do this, we may use both session cookies, which expire when you close our web browser, and persistent cookies, which stay on your computer until you delete them. If you do not want the services to place a cookie on your hard drive, you may be able to turn that feature off on your computer or mobile device. However, if you decide not to accept cookies from us, the services may not function properly.

We may use third-party analytics services (such as Google Analytics) to evaluate your use of the services, compile reports on activity, collect demographic data, analyze performance metrics, and collect and evaluate other information relating to the services and mobile and Internet usage. These third parties use cookies and other technologies to help analyze and provide us the data. The information used in such analytics services are generally at the aggregate level, and do not include any personally identifiable information. By using the services, you consent to the processing of data about you by these analytics providers in the manner and for the purposes set out in this Privacy Policy.

4. HOW WE USE THE INFORMATION WE COLLECT

Splickit may share non-personal information (e.g., anonymous, aggregated data) without restriction. Splickit may share your personal information as described in this Privacy Policy and with its restaurant partners, service providers, and suppliers to the extent necessary to deliver the the services you requested, respond to your requests for information on your use of the services, or otherwise necessary to support your ordering needs. If you opt out of sharing your information with these third-party service providers for these purposes, we may be unable to provide the Splickit ordering Services or support you requested.

4.1 We use the Personal Information and the Other Information to provide you access and use of the Services, administer rewards, referrals, and promotional programs, and to improve our service to you. We use the billing Information to process your orders, and we use the geolocation information to recommend nearby restaurants to you. Also, we may share Personal Information and/or Other Information as described below.

4.2 In order to provide you our services, we need to share your name, phone number, meal order, and your physical address if you are ordering for delivery, with the restaurants from which you order. In addition, the restaurant may share your information with any third parties that are involved in, or provide services in connection with, such orders, such as delivery services. Such parties will use such information in accordance with the terms of their privacy policies.

4.3 In order to administer rewards, referrals, and promotional programs, we may share your Personal Information and Other Information with the restaurants from which you order.

4.4 In addition, we may share your Personal Information with restaurants from which you order so they may provide you with information and promotions. However, to the extent required by law, you will be given the opportunity to opt-out of such sharing.

4.5 In an ongoing effort to better understand our users and our services, we might analyze the Other Information in aggregate form in order to operate, maintain, manage, and improve the services. This aggregate information does not identify you personally. We may share this aggregate data with our affiliates, agents, and business partners. We may also disclose aggregated user statistics in order to describe our products and services to current and prospective business partners and to other third parties for other lawful purposes.

4.6 We may employ other companies and individuals to perform functions on your behalf. examples may include providing marketing assistance, order fulfillment, billing, and customer service. These other companies will have access to the Personal Information and Other Information only as necessary to perform their functions and to the extent permitted law.

4.7 As we develop our businesses, we might sell or buy businesses or assets. In the event of a corporate sale, merger, reorganization, sale of assets, dissolution, or similar event, the Personal Information and Other Information may be part of the transferred assets.

4.8 To the extent permitted law, we may also disclose Personal Information and Other Information when required law, court order, or other government or law enforcement authority or regulatory agency, or whenever we believe that disclosing such information is necessary or advisable, for example, to protect the rights, property, or safety of Splickit or others.

We will take reasonable measures to require that the party receiving any of our Personal Information undertakes to: (i) retain and use such information only for the purposes set out in this Privacy Policy; (ii) not disclose your Personal Information except with your consent, as permitted law, or as permitted in this Privacy Policy; and (iii) generally protect the privacy of your Personal Information.

5. ACCESSING AND MODIFYING PERSONAL INFORMATION AND COMMUNICATION PREFERENCES

If you have registered for the Services, you may access, review, and make changes to our Personal Information, Billing Information, and certain Other Information by accessing your account information on the Splickit ordering websites or mobile applications

6. RETENTION OF INFORMATION

We will retain your personal information for as long as your account is active or as needed to provide you services. If you wish to cancel your account, or request that we no longer use your personal information to provide you services, contact us via the methods outlined in this document. Even after we cancel your account or cease using your personal information to provide you Services, we may still retain, use, and disclose your information as necessary to comply with our legal, regulatory, ethical, or document retention obligations, and any request to delete your personal information is subject to these obligations and restrictions.

7. SECURITY OF YOUR PERSONAL INFORMATION

Splickit has implemented technical, administrative, and physical measures designed to protect your personal information from accidental loss or from unauthorized access, disclosure, use, alteration or destruction. These measures include computer safeguards, secured files, internet firewalls, intrusion detection, anti-virus protection, network monitoring, and, where appropriate and required by applicable law, Transport Layer Security (“TLS”) or similar encrypted browsers. However, no electronic data transmission or storage of information can be 100% private and secure, and you understand that Splickit does not ensure or warrant the privacy or security of any information we collect from or about you, and that your use of the Splickit Services, and providing us with information is at your own risk. It is your responsibility to keep your password confidential, and to be careful to avoid “phishing” scams where someone may send you an email that looks like it is from Splickit, or our restaurant partners, asking for personal information. Splickit will never request personal information through email. If you have any questions about the security of your personal information, you can contact us as set forth in this document.

8. CALIFORNIA RESIDENT

If you are a California resident, California Civil Code Section 1798.83 permits you to request information regarding the disclosure of your personal information by Splickit to its affiliates and/or third parties for direct marketing purposes with the past year. To make this request, contact us as set forth in this document.

9. CHILDREN

We do not knowingly collect Personal Information from children under the age of 13 through the services. If you are under 13, please do not give us any Personal Information. We encourage parents and legal guardians to monitor their children’s Internet usage and to help enforce our Privacy Policy by instructing their children to never provide us Personal Information without their permission. If you have reason to believe that a child under the age of 13 has provided Personal Information to us, please contact us, and we will endeavor to delete that information from our databases.

10. CHANGES TO THIS PRIVACY POLICY

This Privacy Policy is effective as of the date stated at the top of this Privacy Policy. We may change this Privacy Policy from time to time, and will notify you of such changes (e.g., posting any changes on the services, e-mailing you, or prompting you via a popup) If you access the services after we notify you of such changes to this Privacy Policy, you are deemed to have accepted such changes. Please refer back to this Privacy Policy on a regular basis.
